Plans that are on a "pay as you go" or are "self-funded" are governed by nondiscrimination rules found in Code Section 105(h). Failure to comply with these rules means plan benefits will become
taxable to "highly compensated" employees.

Employers should be aware that if the employer is subject to COBRA the HRA plan would be a COBRA eligible benefit by the COBRA beneficiary.
